The idea that someone has to be in the lead isn't a problem with Fermi's paradox; most people have identified it and noted that it represents the best possible solution of the paradox.

If we're in the lead (or, I suppose, if we're alone), then that means that we don't have to worry that there's a "filter" out there which has wiped out many other civilizations like ours.
